These Terms & Conditions govern your use of the Butterflies & Feathers website and any online purchase, order request, or client service request made through it. By using the site, you agree to these terms to the extent permitted by applicable law.

Butterflies & Feathers is a German-Ghanaian fashion and art business presenting fashion collections, original artworks, and related private client services.

3. Products and Availability
We aim to describe all products as accurately as possible. Many pieces are limited, one-of-a-kind, made in small runs, or subject to stock confirmation. Artworks are typically unique originals unless expressly stated otherwise. Availability, measurements, colours, and material appearance may vary slightly from screen to screen or from one handmade piece to another.
4. Product Images and Presentation
Product and artwork images are used to present the item as faithfully as possible, but differences in monitor settings, lighting, framing, texture, and handmade finishes may cause minor visual variation. Such differences do not by themselves constitute a defect.
5. Prices and Currency
All prices displayed on the site are shown in EUR unless stated otherwise. Shipping, customs duties, import taxes, and similar charges may be charged separately unless expressly included in the displayed price.
6. Order Process
Adding an item to the bag does not reserve it. An order request is only submitted when you complete the checkout process. We may need to review stock, artwork availability, address information, payment verification, and fulfilment feasibility before accepting or completing an order.
7. Payment
Payment routes may include Stripe, PayPal, and other providers made available on the site. By choosing a provider, you may also become subject to that provider's own terms and privacy practices. We reserve the right to refuse or cancel an order where payment cannot be verified, a fraud or compliance risk is identified, or the selected item is unavailable.
8. Shipping and Delivery
We coordinate fulfilment across Germany, Ghana, and selected international destinations. Delivery times are estimates only and may vary depending on destination, customs, stock readiness, made-to-order timelines, and carrier performance. Risk transfers according to applicable law and the agreed delivery arrangement.
9. Customs, Duties and Import Charges
For cross-border orders, the customer is responsible for any customs duties, import VAT, clearance fees, or similar charges unless we explicitly state otherwise at checkout or in writing.
10. Returns, Refunds and Withdrawal Rights
Your rights to cancel, return, or obtain a refund depend on the product, the country of sale, and mandatory consumer law. If EU consumer law applies to your order, distance-sale customers generally have a 14-day right of withdrawal, subject to legal exceptions. Please read our separate Refund Policy for details.
11. Exceptions to Withdrawal and Returns
Where permitted by law, the right of withdrawal may not apply to goods made to order, clearly personalised goods, or services already fully performed with your express prior consent. Special handling may also apply to commissioned works, customised pieces, altered garments, custom framing, or sealed goods that cannot be returned once opened for hygiene or integrity reasons.
12. Faulty or Misdescribed Goods
Nothing in these terms limits your mandatory statutory rights if a product is defective, damaged in transit, or materially not as described. If that happens, contact us promptly with your order reference and supporting evidence so we can review the issue.
13. Intellectual Property
All content on this website, including text, imagery, branding, logos, design elements, editorial copy, and product presentation, is owned by or licensed to Butterflies & Feathers unless stated otherwise. You may not reproduce, republish, extract, or commercially use that content without prior written permission.
14. Website Use
You agree not to misuse the site, interfere with its operation, submit false order information, attempt unauthorised access, or use the site in a way that infringes the rights of Butterflies & Feathers or any third party.
15. Liability
To the fullest extent permitted by law, we exclude liability for indirect or consequential loss. Nothing in these terms excludes or limits liability that cannot legally be excluded, including liability for fraud, wilful misconduct, death, personal injury caused by negligence, or mandatory consumer rights.
16. Governing Law and Consumer Protection
These terms should be governed by the law specified in the final legal version published by Butterflies & Feathers, without depriving consumers of any mandatory protections available under the law of their habitual residence where such protections apply.
